These terms apply to all users of the ArtistsZone platform, including students enrolled through an institutional license, students who purchase directly, schools and institutional administrators, and visitors browsing the public website. By accessing or using any part of the ArtistsZone platform, you agree to these terms. If you do not agree, do not use the platform.

ArtistsZone LLC (“ArtistsZone,” “we,” “us,” or “our”) is a Georgia limited liability company. We operate the Beyond The Portfolio™ course and the ArtistsZone platform at artistszone.net. Our mailing address is Atlanta, Georgia. Contact: legal@artistszone.net.

• Students — individuals enrolled in the Beyond The Portfolio™ course, whether through an institutional license or a direct purchase.
• Institutional Users — schools, colleges, universities, and their authorized administrators who have executed an Educational License Agreement with ArtistsZone.
• Consumers — individuals who purchase access to the course directly through our website.
• Visitors — anyone who browses the public-facing ArtistsZone website without creating an account.

You must be at least 18 years old to access or use the ArtistsZone platform. By creating an account or purchasing access, you represent that you are 18 or older. We do not knowingly collect personal information from anyone under 18. If we learn that a user is under 18, we will terminate their account and delete their data. Institutional Users are responsible for ensuring that no student under 18 is enrolled through their license.

Subject to these Terms and, where applicable, your Educational License Agreement, ArtistsZone grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Beyond The Portfolio™ course and platform solely for your own personal, non-commercial educational purposes. All rights not expressly granted are reserved by ArtistsZone.

You agree not to:

• Share, sell, transfer, or allow others to use your account or login credentials;
• Record, screen-capture, download, or reproduce course video content beyond the downloadable materials we expressly provide;
• Use automated tools, bots, crawlers, or scrapers to access or index any part of the platform;
• Upload or transmit malicious code, viruses, or disruptive content;
• Harass, threaten, defame, or abuse other users, instructors, or ArtistsZone staff;
• Use the platform or course content to develop or offer a competing marketing education product for visual artists, graphic designers, or illustrators;
• Attempt to gain unauthorized access to any part of the platform or its underlying systems;
• Misrepresent your identity or affiliation;
• Use the platform in any way that violates applicable law.

All content on the ArtistsZone platform — including course videos, written materials, worksheets, frameworks, templates, graphics, logos, and software — is owned by or licensed to ArtistsZone LLC and is protected by U.S. and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, or publicly display any platform content without our prior written permission. ArtistsZone’s name, logo, and Beyond The Portfolio™ are trademarks of ArtistsZone LLC.

ArtistsZone commits to 99.86% platform uptime per calendar month, excluding scheduled maintenance and Force Majeure Events. Scheduled maintenance occurs between 10:00 p.m. and 7:00 a.m. Eastern Time with at least 24 hours’ advance notice. Temporary unavailability does not entitle you to a refund except as described in Part 2.

If you initiate a chargeback for a charge not eligible for a refund under these Terms, ArtistsZone reserves the right to suspend your account pending resolution and to recover any chargeback fees incurred. Repeated or fraudulent chargebacks may result in permanent account termination.

Nothing in this Refund Policy limits any statutory refund right you have under applicable consumer protection law. See Parts 3–6 for jurisdiction-specific provisions.

Residents of Colorado (CPA), Virginia (VCDPA), and Connecticut (CTDPA) have the right to: (a) access personal data; (b) correct inaccurate personal data; (c) delete personal data; (d) obtain a portable copy; and (e) opt out of profiling for significant decisions. ArtistsZone does not sell covered information as defined under Nevada Revised Statutes Chapter 603A. Questions: privacy@artistszone.net.

To the extent ArtistsZone processes Education Records on behalf of an educational institution, ArtistsZone acts as a school official with a legitimate educational interest. ArtistsZone will not re-disclose Education Records except as permitted by FERPA and the applicable Educational License Agreement. Students and parents may exercise FERPA rights through the enrolling institution.

The ArtistsZone platform is not directed at children under 13. Users must be at least 18. If we become aware that a user under 13 has provided personal information, we will delete it immediately. Contact: privacy@artistszone.net.

For users in the EEA and UK, ArtistsZone LLC acts as the data controller of your personal data. Contact: privacy@artistszone.net.

• Contract performance — to deliver the course and platform services.
• Legitimate interests — to improve our platform, prevent fraud, and communicate relevant updates.
• Consent — for marketing communications and non-essential cookies. Withdraw at any time.
• Legal obligation — where required by applicable law.

• Erase your personal data in certain circumstances (Article 17);
• Restrict processing in certain circumstances (Article 18);

• Lodge a complaint with your local supervisory authority.

ArtistsZone is based in the United States. EEA transfers rely on Standard Contractual Clauses (SCCs); UK transfers rely on the UK IDTA. A copy is available upon request at privacy@artistszone.net.

We retain personal data as long as necessary to provide platform services. For students who do not continue using the platform after their access term ends, we delete or anonymize personal data within 60 days of term expiration.

EEA users may lodge a complaint with their national data protection authority. UK users may contact the Information Commissioner’s Office at ico.org.uk.

EU and UK consumers may have a 14-day cooling-off right for digital content purchases under the EU Consumer Rights Directive and UK Consumer Contracts Regulations. At checkout, you will be asked to consent to immediate access and acknowledge that the right of withdrawal does not apply once performance has begun.

ArtistsZone handles personal information of Canadian users in accordance with PIPEDA and applicable provincial privacy laws, including Alberta’s PIPA, British Columbia’s PIPA, and Québec’s Law 25 (Bill 64).

We collect, use, and disclose personal information with your knowledge and consent. You may withdraw consent at any time by contacting privacy@artistszone.net, subject to legal or contractual restrictions.

You have the right to: (a) request access to your personal information; (b) challenge accuracy and request correction; and (c) know whether we hold personal information about you. Contact: privacy@artistszone.net. Response within 30 days.

Your personal information may be transferred to and processed in the United States. By using the platform, you acknowledge that your information may be subject to U.S. law. We use contractual protections for information transferred outside Canada.

For Québec users, we comply with Law 25 / Bill 64, including: (a) publishing this Privacy Policy in a clear and accessible format; (b) obtaining meaningful consent; (c) providing data portability where required; (d) conducting privacy impact assessments for high-risk data uses; and (e) notifying the CAI and affected individuals of confidentiality incidents involving serious risk of injury.

Nothing in our Refund Policy limits your statutory rights under applicable provincial consumer protection legislation.

ArtistsZone handles personal information of Australian users in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

We collect personal information only by lawful and fair means and only where reasonably necessary to deliver the platform services.

You have the right to: (a) access the personal information we hold; (b) request correction of inaccurate or incomplete information; and (c) make a complaint about our handling of your personal information. Contact: privacy@artistszone.net. Response within 30 days.

Your personal information may be disclosed to recipients in the United States. We take reasonable steps to ensure overseas recipients handle your information consistently with the APPs.

If unsatisfied with our response to a privacy complaint, you may lodge a complaint with the OAIC at oaic.gov.au.

Nothing in our Refund Policy excludes, restricts, or modifies any right or remedy under the Australian Consumer Law (Schedule 2, Competition and Consumer Act 2010), including consumer guarantees that cannot be excluded by contract.

• To create and manage your account and provide access to the course;
• To process payments and manage billing;
• To track course progress and issue certificates of completion;
• To send transactional emails (enrollment confirmation, course reminders, account notices);
• To send marketing communications where you have consented or where permitted by law;
• To improve the platform and course content using aggregated and anonymized usage data;
• To detect and prevent fraud, abuse, and security incidents;
• To comply with legal obligations;
• To use your name, likeness, and testimonials in marketing materials as described in Section 8.3 of Part 1.

We retain personal information for as long as your account is active and as needed to provide platform services. For students who do not continue using the platform after their access term ends, we delete or anonymize personal data within 60 days of term expiration.

We implement reasonable administrative, technical, and physical safeguards including encryption in transit and at rest, role-based access controls, and regular security assessments. In the event of a data breach, we will notify affected users and applicable authorities as required by law.

The platform may contain links to third-party websites. We are not responsible for the privacy practices of those sites.
